These Terms of Service ("Terms") constitute a legally binding agreement between you, the individual or organization accessing our services ("you" or "User"), and Stats Dugout ("Stats Dugout," "we," "us," or "our"). These Terms govern your access to and use of the Stats Dugout platform, website at statsdugout.com, and all related services (collectively, the "Services").
By creating an account, subscribing, or otherwise accessing the Services, you confirm that you have read, understood, and agree to these Terms in full. If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you meet this requirement.
Stats Dugout provides a baseball information and analytics platform. The Services aggregate, organize, and display baseball-related information — including player statistics, game scores, rosters, transactions, injury updates, and other sports data — sourced from various publicly available sources (collectively, "Sports Data"). Stats Dugout does not own, generate, or independently verify this data.
Stats Dugout is an informational aggregation tool. We are not affiliated with, endorsed by, licensed by, or sponsored by any professional sports league, team, player association, governing body, or any data provider from which Sports Data may be derived. Access to certain features of the Services requires a paid subscription.
The Services include features such as player stat tracking across multiple levels of baseball, game-completion email notifications, live game status updates, transaction and roster move alerts, and injury update monitoring. Feature availability varies by subscription tier. We reserve the right to add, modify, or remove features at any time without prior notice.
You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. Minors may not use the Services under any circumstances.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when registering and to keep that information up to date. You agree to notify us immediately at [email protected] of any unauthorized use of your account.
Stats Dugout is not liable for any loss or damage arising from your failure to safeguard your credentials or from unauthorized use of your account. We reserve the right to suspend or terminate any account that we reasonably believe has been compromised, is in violation of these Terms, or poses a risk to other users or to our platform.
You may not create or operate more than one account per person, or create accounts for the purpose of circumventing access restrictions or subscription limits.
Access to premium features of the Services requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, as selected at checkout. All fees are stated in U.S. dollars. Payment is processed by a third-party payment processor; we do not directly store your full payment card details.
Fully refundable within 7 days. Refunds can be requested within 7 days of purchase. After this period, fees are non-refundable except as required by applicable law. We do not provide prorated refunds for partial billing periods, subscription downgrades, or early cancellations. If you believe you were charged in error, contact us at [email protected] within 14 days of the charge and we will review your request.
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period, after which your account will revert to the free tier. We reserve the right to modify our pricing at any time. We will provide reasonable advance notice of any price changes. Continued use of the Services after a price change constitutes acceptance of the new pricing.
In the event of non-payment, failed charges, or chargebacks, we reserve the right to immediately suspend or terminate your access to premium features. You are responsible for all taxes or levies imposed by any governmental authority in connection with your purchase of the Services.
Free tier limitations. Free accounts are subject to feature and usage restrictions as described on our pricing page. We reserve the right to modify free tier limits at any time.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree that you will not:
We reserve the right to investigate suspected violations and to suspend or terminate accounts involved in any violation, without notice and without liability. We may report suspected illegal activity to appropriate law enforcement authorities.
The Services display sports statistics, scores, game information, player data, transaction records, injury updates, and other baseball-related content ("Sports Data") aggregated from publicly available sources. This data is provided as-is, for informational and entertainment purposes only.
No warranty of accuracy. Stats Dugout makes no representations or warranties, express or implied, regarding the accuracy, completeness, timeliness, reliability, or fitness for any particular purpose of any Sports Data displayed through the Services. Sports Data may contain errors, omissions, delays, or outdated information. Data may reflect incorrect scores, statistics, rosters, transaction dates, injury statuses, or other details. Stats Dugout does not audit, verify, or independently confirm any Sports Data before displaying it.
Data may be delayed or incomplete. Live game data, scores, and player statistics may be subject to delays. Final statistics may differ from in-game estimates. Historical data may be retroactively corrected by the relevant league or governing body without notice to us, and our displayed data may not reflect such corrections.
Your responsibility for data use. You are solely and exclusively responsible for how you use, interpret, share, distribute, publish, or act upon any Sports Data obtained through the Services. Stats Dugout is not responsible or liable for any decisions, actions, outcomes, or consequences arising from your use of Sports Data — including but not limited to fantasy sports decisions, sports wagering or betting decisions, personnel decisions, business decisions, content creation, media publication, or any other purpose — regardless of whether such data was accurate, complete, timely, or reliable.
Not for wagering or high-stakes decisions. Stats Dugout is an informational tool and is explicitly not intended as a primary or authoritative data source for sports wagering, gambling, fantasy sports contests with monetary entry fees, or any other purpose where data inaccuracies could result in financial harm. If you choose to use the Services in connection with such activities, you do so entirely at your own risk and Stats Dugout expressly disclaims all liability for outcomes arising therefrom.
No endorsement. Display of Sports Data does not constitute our endorsement of any player, team, organization, or data source. Player names, team names, league names, and related marks are the property of their respective owners.
The Services include optional email notification and browser push notification features that alert you to game completions, live game events, player transactions, and other updates for players you have chosen to track. These notifications are provided on a best-effort basis and are not guaranteed to be delivered, timely, or accurate.
No guarantee of delivery. Notification delivery depends on third-party email and push notification infrastructure and is subject to delays, failures, filtering by email providers, and other technical limitations beyond our control. We are not liable for any missed, delayed, or undelivered notifications, or for any consequences arising from your reliance on notifications.
By enabling notifications, you consent to receiving the categories of notifications you have enabled. You may disable notifications at any time through your account settings. Transactional account-related emails (such as password resets and account verification) are not subject to opt-out while your account is active.
The Stats Dugout platform, brand, logo, software, user interface, design elements, and all original content created by Stats Dugout are our exclusive intellectual property and are protected by copyright, trademark, and other applicable laws. Nothing in these Terms grants you any right to use our trademarks, trade names, logos, or other brand features without our prior written consent.
Sports Data displayed through the Services originates from publicly available sources and is not owned by Stats Dugout. We do not claim ownership rights in Sports Data. Your use of Sports Data obtained through the Services does not create any license or ownership rights in such data.
By submitting any content or feedback to us (including bug reports, feature suggestions, or other communications), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and incorporate such content for any purpose related to improving the Services, without any obligation to compensate you.
The Services may display links to, or integrate with, external websites, services, or platforms not operated by Stats Dugout. These third-party services are governed by their own terms and privacy policies. We have no control over and assume no responsibility for the content, privacy practices, accuracy, or availability of any third-party service. The inclusion of any link or integration does not imply our endorsement of the linked service.
We use third-party service providers to operate the Services, including payment processing, email delivery, and analytics. These providers process information on our behalf subject to their own terms and privacy policies. Stats Dugout is not responsible for the actions or omissions of any third-party provider.
THE SERVICES, INCLUDING ALL SPORTS DATA AND OTHER CONTENT, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, TIMELINESS, OR NON-INFRINGEMENT. STATS DUGOUT DOES NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (B) ANY SPORTS DATA WILL BE ACCURATE, COMPLETE, OR TIMELY; (C) THE SERVICES WILL MEET YOUR REQUIREMENTS; OR (D) DEFECTS IN THE SERVICES WILL BE CORRECTED. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM STATS DUGOUT OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STATS DUGOUT, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS; LOSS OF DATA; LOSS OF BUSINESS OR GOODWILL; FINANCIAL LOSSES ARISING FROM SPORTS WAGERING, GAMBLING, FANTASY SPORTS, OR SIMILAR ACTIVITIES; MISSED GAME NOTIFICATIONS; INACCURATE OR DELAYED SPORTS DATA; COST OF SUBSTITUTE SERVICES; OR ANY OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH: (I) YOUR USE OF OR INABILITY TO USE THE SERVICES; (II) ANY SPORTS DATA DISPLAYED THROUGH THE SERVICES; (III) ANY NOTIFICATION THAT WAS DELIVERED LATE, NOT DELIVERED, OR CONTAINED INACCURATE INFORMATION; OR (IV) ANY OTHER MATTER RELATING TO THE SERVICES, EVEN IF STATS DUGOUT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL STATS DUGOUT'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO STATS DUGOUT IN THE THREE (3) CALENDAR MONTHS IMMEDIATELY PRECEDING THE DATE THE CLAIM AROSE, OR (B) TWENTY-FIVE U.S. DOLLARS ($25.00).
THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
You agree to defend, indemnify, and hold harmless Stats Dugout and its owners, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, judgments, awards, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
Stats Dugout reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense. You agree to cooperate with our defense of such claims.
Stats Dugout may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, are engaging in conduct harmful to other users or our platform, or for any other reason at our sole discretion, without liability to you.
Upon termination, your right to access the Services will immediately cease. If your account is terminated for a violation of these Terms, you are not entitled to a refund of any prepaid fees.
You may close your account at any time by contacting us at [email protected]. Account closure takes effect as described in our Privacy Policy.
All provisions of these Terms that by their nature should survive termination shall survive, including without limitation Sections 6, 8, 10, 11, 12, and 14.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. If you have a dispute with us, please reach out first at [email protected] — we will make a good-faith effort to resolve it informally within 30 days.
If informal resolution is not achieved, you and Stats Dugout agree to submit any dispute to binding individual arbitration. Claims must be brought on an individual basis only; neither party may bring a claim as part of a class action, class arbitration, or any other representative proceeding. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction where immediate, irreparable harm would otherwise result.
We reserve the right to modify these Terms at any time. We will update the "Last Updated" date at the top of this page when changes are made. For material changes, we will provide notice via email or a prominent notice on the Services. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.
